Employers have legal safety responsibility

According to a recent news story in ‘The Salinas Californian’ newspaper,
it was reported from Monterey County that California Court of Appeal has confirmed an employer’s duty to at least attempt to provide a workplace that is relatively free of violence.
This all came about due to the court case of Franklin v. The Monadnock Co.
According to Franklin’s complaint, Monadnock allegedly did not either counsel or at least warn the worker who had made a violent threat. In addition to this, Monadnock allegedly did not even keep the worker who
had made this threat at any distance from Franklin or the other workers who were likewise threatened.
About seven days following Franklin’s complaint, the worker who had made the violent threats tried to stab him with a screwdriver.
 Following this altercation, he went on to file a complaint with the police department. Then following these events, Franklin (the stabbing victim) was himself fired by the company, according to the court document.
He says that he was actually fired from his job due to his repeated complaints and police attention to the matter. That is the reason that he has filed the legal suit against his former employer, he says.
The court then found that there is specific policy in place in the Golden State compelling employers to take certain steps within reason to provide a safe & secure work environment.
 Their are simply mandated to adequately deal with possible workplace violence, which this particular company apparently did not do.
The court verified that employers have to be responsive to various security threats to their workers. Any reports of such have to be addressed right away or they must face legal penalties.

California Foreclosures Way Up this year

According to the respected Bloomberg news network, foreclosures in the United States rose to a rate of nearly sixy percent in the first half of 2007 from the year before, with California leading all states in this infamous respect,
as more and more homeowners are falling behind on their mortgage payments, unfortunately. The Bloomberg news network got this data from Realtytrac inc. according to their website. Florida was number two on the list, unfortunately.
Mortgage firms sent out legal notices of default, scheduled auctions and/or outright repossessions to over half a million properties in the first six months of the year the Irvine, California-based seller
 of foreclosure data stated in a report yesterday. California foreclosures surged ahead an appalling 170 percent to 104,572, the highest in the country! 
House buyers who are strapped with those now dreaded ARM loans who are seeing their payments climb are finding it much more difficult to escape foreclosure by simply selling or refinancing their properties as the United States housing slump get worse.
The inventory of houses that are available was 8.8 months for June, matching the previous month as the highest since 1992, the National Association of Realtors stated in a report just last week.
And in another unfortunate note, RealtyTrac’s CEO stated that “Foreclosure activity shows no sign of slowing down”.
The reason for the horrible numbers includes subprime mortgage problems as well as house buyers who were simply too optimistic when the housing explosion of a couple of years ago was ending.

Lindsay Lohan’ legal problems take a turn for the worse

Just when celebrity Lindsay Lohan thought her legal luck could not get any worse, it does.
Hollwood.com has recently reported on it’s website that the individual whose foot Lindsay Lohan drove over
 as she exited a party is now threatening to sue her. Ouch, being a celebrity is not all it’s cracked up to be these days I guess.
The spotlight is just on you all the time, apparently. This story, coming as it does on the heels of the Paris Hilton and Jansport president’s death while driving drunk, seems to indicate a growing theme in California.
The news story reported that Ronnie Blake, whi was 1 of 3 partygoers who happened to be inside a white GMC SUV when the reportedly drunk actress supposedly took over the car to go after
Tarin Grahame through the streets of Malibu, California. Yes the same Malibu where Mel Gibson was also pulled over for driving while drunk last summer. Something about the scene, I guess.
Anyway he was able to exit the car right as Lohan took off, along with his 2 friends Dante Nigro & Jakon Sutter. They apprently were fearing for their very lives inside, prompting their move.
All 3 of these guys have retained veteran southern California based lawyer Randall Billington as they ponder legal action against her.
If the case does indeed go to court at all, they will be seeking damages for their injuries, and Nigro and Sutter may even claim both false imprisonment as well as stolen-vehicle charges as well.

Jansports President had a high blood alcohol level

The San Jose Mercury News, in a story reprinted on the MediaNews website, has recently reported that the executive killed in a recent automobile accident, president of the outdoor gear firm JanSport,
had a blood alcohol threshhold that was higher than the legal limit at the time of his unfortunate death.
As a matter of fact, it was almost 3 times that of the legal limit, according to the California Highway Patrol.
A resident of Danville, he crashed off of Camino Tassajara on the late afternoon of July 14, according to the news story.
While the 2 teenagers traveling with him (his daughter and boyfriend, apparently) suffered relatively minor injuries,
Corvino himself suffered massive trauma to both the head and chest. None of the passengers in his vehicle were wearing seatbelts at the time of the accident in question.
According to eyewitness accounts, the said vehicle was  rapidly accelerating just prior to the collision. Just how fast the vehicle was going is open to debate until the
investigation is fully finished, and that should be in about 2 weeks or so.

Los Angeles landlords being targeted in marijuana legal battle

According to a recent article in the USA Today online newspaper,
the DEA has been escalating it’s already somewhat intense attacks on marijuana sales that are legal under California law at this point in time and yet are at the same time
 not legal under federal law. Basically, the Drug Enforcement Agency  has been focusing it’s assaults on  landlords and has been executing a number of search warrants on some ten marijuana dispensaries across the city of Los Angeles.
Even as the agents were pushing in, the L.A. City Council voted unanimously to (tentatively at least) approve a 1 year moratorium on more medical marijuana stores, which have quickly grown in number over the past 2 years or so.
All in all, government officials have calculated that there are about four hundred or so office operations which are currently selling medical marijuana in L.A. County, which is up from about twenty just 2 years ago,
 DEA Special Agent Sarah Pullen stated. Officials have claimed that the sales have become a source for recreational pot users, nor just individuals with a medical condition that could require it, such as a loss of appetite, for instance.
According to the USA Today report, perhaps the most severe threat to the Golden State’s marijuana sales came in a letter recently from the DEA to one hundred and fifty property owners or managing landlords letting them know one of their tenants is operating a marijuana dispensary on the property.
